These Terms & Conditions govern your use of thespraymarket.com and any purchase you make from The Spray Market. Please read them, in particular Section 8 (Equipment safety, training and chemicals) and Section 10 (Limitation of liability).
1. Who we are
The Spray Market, 162 2nd Avenue, Brooklyn, NY 11215. Telephone (718) 788-6800. Email info@thespraymarket.com. In these Terms, “we”, “us” and “our” mean The Spray Market; “you” means the customer.
2. Trade and professional customers
We supply professional spray foam, coating and insulation equipment, replacement parts and chemicals, primarily to trade customers. By placing an order you confirm that you are at least 18 years old, that you are buying for business or professional use, and that you and your personnel are trained and qualified to use the products safely.
3. Your account
You are responsible for the accuracy of the information on your account, for keeping your password confidential, and for all activity under your account. Tell us promptly if you believe your account has been used without your authorisation. We may suspend or close an account that is used in breach of these Terms.
4. Prices
Prices are in US dollars and exclude sales tax and shipping unless stated otherwise. Account customers may see contract pricing once signed in; that pricing is confidential to your account and is not to be shared. We reserve the right to correct pricing, specification and description errors, and to cancel an affected order before shipment. If you have already been charged for a cancelled order, you receive a full refund.
5. Orders and acceptance
Your order is an offer to buy. A contract is formed only when we accept it, either by shipping the goods or by written confirmation. We may decline an order, limit quantities, or require a deposit on special orders and on equipment.
6. Payment
Card payments are authorised when you place the order and captured when the order ships or is delivered. Approved account customers may be offered credit terms in writing. If a payment is declined or fails, your order may be delayed or cancelled.
7. Sales tax and exemptions
We collect New York State and local sales tax where required. If you are buying for resale or are otherwise exempt, we need a valid and current exemption certificate — for example New York Form ST-120 — on file before your order is processed. Without a certificate on file, tax is charged. It is your responsibility to keep your certificate current and to tell us if your exempt status changes.
8. Equipment safety, training and chemicals
Please read this section carefully. High-pressure plural-component spray equipment operates at pressures capable of injecting fluid through skin and causing serious injury or death. Spray polyurethane foam and coating chemicals contain isocyanates, amines, blowing agents and other substances that require respiratory protection, skin and eye protection, ventilation, and trained handling.
- You are responsible for reading and following the manufacturer’s manual, warnings, labels and Safety Data Sheets before using any product.
- You are responsible for training your personnel, supplying appropriate personal protective equipment, and complying with all applicable OSHA, EPA, state, local, fire and building code requirements.
- We are a distributor. We do not design or manufacture the products we sell. We do not provide engineering, industrial hygiene, code compliance or application design advice. Any help we give with part identification, machine sizing or product selection is a good-faith suggestion based on the information you give us — it is not a professional opinion and does not transfer responsibility for the outcome to us.
- Do not modify equipment, exceed rated pressures or temperatures, or fit parts that the manufacturer has not approved for that machine.
- Chemicals must be stored, handled, transported and disposed of in accordance with the SDS and applicable law.
9. Warranties
New products carry the manufacturer’s warranty only. We pass that warranty through to you and will help you administer a claim, but we do not extend, enlarge or add to it. Warranty terms, duration and remedies are set by the manufacturer.
Except as expressly set out above, and to the fullest extent permitted by law, we disclaim all other warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. Used, refurbished, clearance and “as-is” items are sold without warranty unless we state otherwise in writing.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, lost production, equipment downtime, jobsite delay, rework, remediation, removal or reinstallation costs, or loss of business or data, arising out of or connected with any product purchased from us or your use of this site — even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim will not exceed the amount you actually paid for the specific product that gave rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
11. Indemnity
You agree to indemnify, defend and hold us harmless from and against any claim, loss, liability, penalty or expense (including reasonable legal fees) arising from your use, application, resale or handling of products bought from us, your failure to follow manufacturer instructions or Safety Data Sheets, your failure to provide required training or PPE, or your breach of these Terms.
12. Shipping, returns and cancellations
Our Shipping Policy and Refund & Returns Policy form part of these Terms.
13. Intellectual property
The content of this site — including product photography, descriptions, parts diagrams and compiled data — is our property or is licensed to us, and may not be copied, scraped or reused commercially without our written permission. Manufacturer names, part numbers, model designations and trademarks remain the property of their respective owners. We are an independent distributor, and we use those marks for identification only.

15. The website
This site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free or free of harmful components, and product availability, stock figures and lead times shown on the site are indicative rather than guaranteed.
16. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including manufacturer supply shortages, carrier or freight disruption, labour action, severe weather, fire, pandemic, or act of government.
17. Governing law and jurisdiction
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in Kings County, New York have exclusive jurisdiction over any dispute, and you consent to venue in those courts.
18. General
If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies referred to in them, are the entire agreement between us regarding your purchase, and they prevail over any purchase-order terms you send us unless we agree otherwise in writing.
19. Changes
We may update these Terms from time to time. The version in force is the one posted at the time you place your order, and the “Last updated” date above shows the current version.
